Monitor by Ruoom Terms of Service

Effective October 19, 2026 · Version 2026-10-19

These Terms of Service govern Monitor by Ruoom, the website and application monitoring service provided by Ruoom Inc. ("Ruoom," "we," "us"). They apply specifically to Monitor by Ruoom, rather than Ruoom's other products or general marketing website. By accepting these terms, you enter into an agreement with Ruoom. If a separately signed agreement expressly governs your use of Monitor by Ruoom, that agreement controls to the extent of any conflict.

1. Your account and workspace

You must be at least 18 and legally able to enter into this agreement. If you create or manage a workspace for an organization, you represent that you have authority to bind that organization. In these terms, "you" means that organization or, if you use the service personally, you as an individual.

Provide accurate account and billing information, keep it current, protect your passwords and sign-in codes, and tell us promptly about suspected unauthorized access. Each person should use their own account. Workspace owners are responsible for the people they invite, the permissions they grant, and activity they authorize. Invited users must also accept these terms and act within the workspace's permissions.

2. What the service does

Monitor by Ruoom periodically checks the apps, websites, and endpoints you configure and can send alerts, show history, and publish status information. Depending on your plan and connections, it can also receive resource metrics, deployment information, backup status, and application or visitor error reports.

You must own or have permission to monitor each resource and connect each integration. You choose the monitoring settings, thresholds, alert recipients, and any information made public through status pages. You are responsible for keeping these settings and connections working and for deciding how to investigate and respond to results.

Checks are samples taken from our monitoring infrastructure. Response times and availability can differ from what your visitors experience. Network conditions, third-party services, configuration, and missing or delayed data can affect results. A healthy result does not prove that every feature is working; an alert does not by itself identify a root cause. Email delivery and detection times are not guaranteed.

The service does not repair your systems, create or restore your backups, or replace your own security, incident response, or business continuity processes. It is not designed for emergency response or other uses where a missed or delayed alert could cause death, personal injury, or serious environmental damage. No uptime guarantee or service-level credit applies unless we agree to one separately in writing.

3. Plans and access

Free currently includes monitoring for one app and access for the workspace owner only. Pro currently starts at US$19 per workspace per month for three apps, with additional apps at US$5 each per month. Pro includes up to 10 teammates in addition to the owner across the workspace. Pending teammate invitations count toward that limit. App slots, rather than the number of apps currently added, determine your Pro subscription price.

The pricing page and checkout show the features, limits, billing period, and price offered when you subscribe. Applicable taxes may be added at checkout. A promotional or separately agreed offer may have different terms that we disclose with that offer. Creating an account or selecting Pro during signup does not itself start a paid subscription; payment must be confirmed.

Plan limits apply to monitoring, history available in the product, public status pages, teammates, alert recipients, and other features. History availability is not a promise that underlying records will be deleted at the end of that period. Retention is addressed in our Privacy Policy.

When a workspace downgrades to Free, teammates lose workspace access and invitations are paused. Saved memberships and app permissions can be restored when the workspace upgrades to Pro again. Apps, settings, and data remain subject to Free limits and our retention practices; do not rely on a downgrade as a way to delete data.

4. Subscriptions, payment, and renewal

Paid subscriptions renew automatically each month until canceled. By confirming a subscription at checkout, you authorize recurring charges for the selected app capacity, applicable taxes, and changes you confirm. Payments are processed by Stripe under its applicable terms and privacy notices. Keep a valid payment method on file.

If you change app capacity, review the price and any prorated charge or credit shown in Stripe before confirming. Added capacity can create an immediate charge; a reduction can create a credit against future charges rather than a cash refund. Removing an app from monitoring does not automatically reduce your purchased app capacity or subscription price.

If payment fails, we may ask you to update your payment method, retry collection through Stripe, and restrict or suspend paid features after notice where reasonably practicable. A temporary continuation of access during collection retries does not waive amounts properly due.

We will give advance notice of changes to recurring prices before they apply to an upcoming renewal. You can cancel before the new price takes effect. We will obtain additional agreement when required by applicable law.

5. Cancellation and refunds

You can cancel automatic renewal through Manage billing in the application. If you cannot access it, contact info@ruoomsoftware.com for assistance. Cancellation normally takes effect at the end of the billing period already paid for, and Pro remains available until then unless access is suspended under these terms. Cancel before renewal to avoid the next charge. Closing a browser, stopping checks, or removing an app does not cancel a subscription.

Fees are generally nonrefundable, including for unused app slots, partial billing periods, or a decision to stop using the service. We may issue a refund at our discretion. This policy does not limit refunds, cancellation rights, or other remedies required by law. Contact us if you believe a charge is incorrect.

6. Your data and privacy

You retain your rights in the content, configuration, and monitoring data you provide ("Customer Data"). You grant Ruoom permission to host, process, transmit, and display Customer Data as needed to provide, secure, maintain, and support the service, follow your instructions, and comply with law. This includes using service providers for those purposes. We do not acquire ownership of Customer Data.

You are responsible for having a lawful basis and any necessary notices, permissions, and agreements for collecting and sharing data with the service, including visitor error information and teammates' or alert recipients' contact details. Do not send passwords, payment card details, special-category personal data, or other sensitive information in monitored responses, error reports, or custom metadata. Scope integration credentials to what is necessary and revoke credentials you no longer need.

Our shared Privacy Policy at https://www.ruoomsoftware.com/privacy-policy/ explains how Ruoom handles personal information, including account, billing, and security information. Acknowledging that notice is separate from consenting to optional marketing. Where we process personal data on a customer's behalf, the customer is responsible for its instructions and applicable data protection obligations. If your use requires a data processing agreement or specific safeguards, contact us to put them in place before sending that data.

Information you choose to publish on a public status page can be viewed and copied by others. Review what you publish. Request any needed copies of your data before closing a workspace; retention, deletion, and legal preservation requirements are described in our Privacy Policy.

7. Acceptable use

Use the service lawfully and within your plan limits. Do not monitor resources without authorization, use checks to attack or overload a system, bypass access controls or usage limits, upload malicious code, interfere with other customers, or use alerts to send unsolicited messages. Do not submit unlawful content or infringe others' privacy or intellectual property rights.

We may block unsafe targets or traffic and investigate suspected misuse. We may suspend the affected account, integration, or monitoring when reasonably necessary to protect the service or others, comply with law, or address a material breach. We will provide notice and a reasonable opportunity to resolve an issue when practicable; urgent security or legal issues may require immediate action.

8. Integrations and outside services

Connected hosting platforms, domain services, email providers, payment services, and other outside systems have their own terms, fees, and availability. You authorize the connections you configure and remain responsible for your agreements with those providers. We do not control their services. Changes or failures in an outside service may affect checks, alerts, billing, or an integration's availability.

9. Our software and brand

Ruoom and its licensors retain their rights in the service, software, documentation, design, and branding. Subject to these terms, you may use the service for your own or your organization's purposes during your subscription. These terms do not transfer ownership of the service or grant a right to resell it. Separate open-source licenses govern components provided under those licenses. If you offer feedback, we may use it to improve the service without an obligation to pay you.

10. Service changes and ending access

We may maintain, improve, or change the service. We will give reasonable advance notice of a material reduction in paid functionality or a planned service shutdown when practicable. If we discontinue a paid service without offering a substantially equivalent replacement before your paid period ends, we will refund the unused prepaid portion, subject to any greater rights required by law.

You may stop using the service and request account or workspace closure by contacting us. Cancel a paid subscription as described above. We may terminate access for a material breach that remains unresolved after reasonable notice, or immediately where necessary for serious misuse, security, or legal reasons. Ending access does not remove payment obligations already incurred. Provisions that reasonably need to continue, including ownership, payment obligations, disclaimers, liability limits, and dispute provisions, survive termination.

11. Disclaimers

To the maximum extent permitted by law, the service is provided "as is" and "as available." Ruoom disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant uninterrupted or error-free operation, detection of every problem, complete or accurate reports, successful delivery of every alert, or prevention of outages, data loss, or security incidents.

Nothing in these terms excludes a warranty, guarantee, or remedy that cannot lawfully be excluded.

12. Limits on liability

To the maximum extent permitted by law, Ruoom and its officers, employees, and service providers are not liable under this agreement for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, business opportunities, goodwill, or data, arising from use of or inability to use the service, even if advised of the possibility.

To the maximum extent permitted by law, Ruoom's total aggregate liability arising out of or relating to the service or these terms will not exceed the fees you paid to Ruoom for Monitor by Ruoom in the three months immediately preceding the event giving rise to the claim. These limits apply regardless of the legal theory of the claim.

These exclusions and limits do not apply to fraud, willful misconduct, or any liability that applicable law does not allow to be excluded or limited. They do not limit your nonwaivable consumer rights.

13. Governing law and disputes

Texas law governs these terms, without regard to its conflict-of-laws rules. Subject to any mandatory rights you have to another law or forum, disputes arising from these terms or the service must be brought in the state or federal courts located in Austin, Texas, and each party submits to those courts' jurisdiction. You may contact info@ruoomsoftware.com to try to resolve a concern informally before bringing a claim; doing so is not a condition that removes any legal remedy.

14. Updates and other terms

We may update these terms and will identify the new version and effective date. We will provide advance notice of material changes by email or in the application when practicable and obtain renewed agreement where required. Changes will apply prospectively, subject to applicable law. If you do not agree to a change, you can cancel renewal and stop using the service before it takes effect.

If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver. These terms, together with any applicable order or separately signed service agreement, form the agreement for Monitor by Ruoom. Neither party is responsible for delays caused by events beyond its reasonable control, except that this does not excuse payment for service already supplied. Notices about your account may be sent to the email address on your account or displayed in the application.
